Cyberonics Inc. has entered into a $9.5 million patent agreement with Ethicon Endo-Surgery Inc. to use the company's vagus nerve stimulation technology.
Under the terms of the agreement, Cincinnati-based Ethicon, a Johnson & Johnson company, has exclusive rights to the Houston medical device-maker's patents and patent applications to use vagus nerve stimulation for the treatment of obesity and two related co-morbidities, diabetes and hypertension, in overweight patients.

Cyberonics (NASDAQ: CYBX - News) said Ethicon will pay the $9.5 million signing fee and royalties on commercial sales of products covered by the subject patents.
